Guyana Court of Appeal upholds Chief Justice’s decision in election petition case

The Court of Appeal in Guyana has upheld Chief Justice Roxane George’s ruling in a case challenging the 2020 general and regional election results.

The case was dismissed, affirming the Chief Justice’s decision to throw out the election petition.

The constitutional Authority of Guyana elections commission affirmed

The Court of Appeal concurred with the earlier High Court ruling, emphasizing that the Guyana Elections Commission had a clear constitutional right to order a recount of the votes cast during the 2020 elections.

No violation of separation of powers

In its comprehensive ruling, the Court of Appeals said it did not find any violation of separation of powers between the executive and legislative branches to make it unlawful or unconstitutional.
