Guyana strengthens local employment policies

In a decisive move to enforce local employment policies, the Local Content Secretariat of Guyana has issued a stern warning to foreign employers.

This warning emphasizes the legal requirements to prioritize qualified Guyanese nationals for job opportunities. 

As part of their regulatory duties, the Secretariat plans to conduct audits ensuring that foreign contractors, subcontractors, and licensees adhere to these stipulations.

Training and development mandates

According to the Local Content Act, alongside the approved Local Content Master Plans and Annual Plans, there is a mandate that when a Guyanese national possesses the necessary qualifications but lacks experience, they must receive the necessary training. 

This directive obliges foreign employers to implement continuous training and capacity development programs. 

This effort aims to bridge any experience gaps and enhance the employability of Guyanese workers within the sector.

Ensuring fair opportunities

The Secretariat has outlined specific compliance requirements for foreign companies operating primarily in the energy sector. 

These companies are now required to demonstrate their efforts in offering equal job opportunities to Guyanese nationals. 

This includes providing evidence of the measures taken to ensure fair application processes for vacancies, equitable benefits for all employees regardless of nationality, and active initiatives to address the experience shortfalls of Guyanese applicants through structured training and mentorship programs.

Consequences of non-compliance

The Secretariat has made it clear that non-compliance with these guidelines could lead to significant repercussions. 

Companies failing to meet these criteria risk being deemed non-compliant, which would impede their ability to receive the Local Content Certificate of Compliance and other critical operational approvals.
