Florida is once again processing driver’s licenses and state ID cards for eligible Temporary Protected Status (TPS) recipients from Haiti, Honduras, and Nicaragua following recent federal court rulings.
According to the Miami-Dade County Tax Collector’s Office, which now oversees local DMV services, TPS holders from Honduras and Nicaragua remain eligible through September 9, while those from Haiti are covered until February 3, 2026.
The resumption follows a decision by U.S. District Judge Brian M. Cogan, who recently rules that Homeland Security Secretary Kristi Noem overstepped her authority by cutting short an 18-month extension of TPS protections granted under the Biden administration. That decision would have ended protections for Haitian nationals as early as September 2. Cogan found the move “unlawful” and granted partial summary judgment in favor of the plaintiffs.
“Secretary Noem’s [decision] was in excess of her authority and was thus unlawful,” Cogan wrote, noting that Haitian TPS holders demonstrated they were “likely to prevail on the merits” and would suffer “irreparable injury” without judicial intervention.
The Miami-Dade Tax Collector, Dariel Fernández, described the rulings as “an important update for many residents in our community navigating the immigration system.”
TPS is a humanitarian designation offered to nationals of countries facing armed conflict, environmental disasters, or other crises. Haitians first received TPS in 2010 after a catastrophic earthquake and have continued to qualify due to ongoing instability.
Earlier this month, the Trump administration announced it would end TPS protections for nearly 80,000 Hondurans and Nicaraguans, who have lived and worked in the U.S. for over 25 years after a devastating hurricane.
This update to the Florida Department of Highway Safety and Motor Vehicles’ guidelines allows many residents who depend on immigration systems to access a valid identity document in the state of Florida and at the federal level.
