TCI responds to US Congressman’s remarks regarding US nationals charged for possession of ammunition

The Turks and Caicos Islands government has expressed disappointment over the remarks made by US Congressman Guy Reschenthaler following his participation in a meeting with a US Congressional Delegation and TCI officials.

The meeting discussed the ongoing case of five US nationals charged with ammunition offenses.

Clash of perceptions

According to a statement released by the Office of the Governor of the Turks and Caicos Islands, headed by Dileeni Daniel-Selvaratnam, the depiction of the meeting by Congressman Reschenthaler does not align with the experiences of the TCI officials. 

The Governor’s Office emphasized that the discussions were conducted in a professional and respectful manner, focusing on the legal aspects and the well-being of the individuals involved.

During an interview with ABC News, Congressman Reschenthaler made several serious allegations, including claims about human rights abuses in the Turks and Caicos prison system, flagged by the UN, and wrongful detentions of Americans. 

He also suggested that the TCI government might be targeting American citizens. However, the Governor’s Office clarified that these assertions do not reflect the reality of their legal and judicial processes.

The statement further detailed that the Turks and Caicos Islands enforce a strict law on firearms and ammunition possession, which includes a mandatory minimum sentence of 12 years and possible fines. 

However, the law allows for judicial discretion in exceptional cases to impose a lesser sentence, ensuring fairness and justice. 

Notably, no US national has been subjected to the mandatory minimum sentence so far.

Upholding justice and constitutional integrity

The Governor’s Office reiterated the independence of their judicial system, which operates free from executive or foreign influence, emphasizing the constitutional separation of powers similar to that of the United States. 

They also stated that all legal proceedings adhere to high professional standards, and any deviations are thoroughly investigated.

UN and human rights observations

In contrast to the allegations, the Governor’s Office noted that there have been no UN sanctions against the local prison, and a recent report by the Turks and Caicos Islands Human Rights Commission in February 2024 found the conditions at the prison to be satisfactory with no human rights violations reported.

Call for respectful dialogue

The Governor of the Turks and Caicos urged for respectful dialogue and stressed the importance of respecting due process and public service integrity. 

The TCI Governor highlighted that misrepresentations do not contribute to constructive discourse and emphasized the equal application of the law to all individuals.

Despite the controversy, the Turks and Caicos Islands remain welcoming to tourists, inviting visitors to experience the natural beauty of the Islands.
